Know the agreement before you book

1. Renter, drivers, and rental record

The person accepting this agreement must be at least 25 years old, hold a valid driver's license for the planned use, and is responsible for the rental and its charges. If you book for a business, you represent that you are authorized to bind that business. An additional driver may tow only with JH's approval, a valid license, and a properly insured tow vehicle. You remain responsible for an approved driver's use of the trailer. Your ID is verified during booking. This agreement does not make a driver or other person personally liable merely by naming them in a definition.

The rented trailer includes its attached equipment and the accessories listed in the reservation or pickup record. The reservation controls which trailer, rate, dates, pickup time, return deadline, and accessories apply. Your rental begins when you take possession. It ends at the completed return time described in Section 8, not when JH later inspects it.

2. Tow vehicle and safe towing

Before pickup and throughout the rental, you must use a tow vehicle, receiver, ball, hitch, wiring, brake controller where required, mirrors, and tires rated and working for the trailer and actual loaded weight. Connect the coupler, safety chains, breakaway cable, lights, and brakes correctly. Check tires, lights, coupler, cargo, and securement before departure and at appropriate stops. Do not tow if a safety-critical part is not working; contact JH first.

Stay within the tow vehicle's ratings, the trailer's gross vehicle weight rating (GVWR), its cargo payload, and applicable road and axle limits. Cargo payload is the maximum weight of cargo, not the trailer's total loaded weight. You are responsible for determining the weight of the actual load and distributing and securing it so towing remains stable.

3. Trailer-specific limits and loading

Lamar 83×14 utility trailer: 83-inch-wide by 14-foot treated-wood deck, payload and GVWR to be confirmed from this trailer’s certification and loading labels before pickup. Contact JH before booking to confirm the planned cargo weight. It uses a single idler axle and has no trailer brakes. Use a 2-inch hitch ball and flat 4-way electrical connection. Confirm that the tow vehicle, loaded combination, stopping ability, and planned route are lawful and suitable for an unbraked trailer. Secure every load, keep cargo within the deck and rails, raise and latch the ramp gate before travel, and do not exceed the payload, GVWR, tow-vehicle ratings, or applicable axle limits.

Freedom Trailers 7×14TA2 enclosed trailer: 7-foot-wide by 14-foot box, rear ramp and side personnel door, maximum cargo payload 4,800 lb, 2 5/16-inch hitch ball, and round 7-pin electrical connection. Measure cargo against the actual interior, door, and ramp openings before pickup. Distribute cargo to maintain safe tongue weight, secure it against shifting in every direction, and close and latch both doors before towing. No person or animal may ride inside the trailer. Do not exceed the cargo payload, trailer or tow-vehicle ratings, or applicable axle limits. Ask JH before using the ramp for heavy rolling equipment if its ramp capacity has not been confirmed for that load.

PJ 20-foot car hauler: 20-foot by 8-foot-6-inch open deck, 82 inches between the fenders, maximum cargo payload 10,580 lb, 2 5/16-inch hitch ball, and round 7-way connection. A working brake controller is required when using the trailer's electric brakes. Center the load, maintain safe tongue weight, secure vehicles or equipment at rated attachment points with suitable independent tie-downs, stow and secure the loading ramps, and recheck securement after initial travel and at reasonable stops. The winch assists loading only; it is not a cargo tie-down. Keep people clear of the cable, hook, fairlead, ramps, and moving load. Do not exceed the trailer's ratings, tow-vehicle ratings, or applicable axle limits even if the cargo is below the payload limit.

Midsota HV14 dump trailer: 82-inch-wide by 14-foot bed, 24-inch sides, 15,400-lb GVWR, maximum cargo payload 10,900 lb, 2 5/16-inch hitch ball, round 7-way connection, and electric brakes. A working brake controller is required. This payload includes all material and equipment carried in or on the bed. Follow the material restrictions and approval requirements in Section 6. Bulk material can exceed the weight limit long before the bed looks full. Establish the actual load weight before towing. Keep bulk material at or below the sides and use the supplied roll tarp for loose material during travel. Spread material evenly from side to side and front to back; keep heavy material low. Do not drop heavy material onto the floor or strike the walls, gates, tarp, hoist, or wiring with loading equipment.

For the dump trailer, load and unload only while parked on firm, level ground with the trailer coupled to a properly rated tow vehicle and the brakes set. Stay clear of overhead power lines and other obstructions; keep all people clear of the gate, bed, hoist, and discharge area. Open and secure the rear doors before raising the bed. Do not drive with the bed raised, climb or reach under a raised bed, or try to free a stuck load by jerking the tow vehicle or striking the trailer. If material sticks, fully lower the bed before addressing the load; do not attempt to free material from a raised bed. Lower and secure the bed, tarp, ramps, and doors before towing. Do not drive equipment up the tuck-under ramps until JH has confirmed that the equipment and ramp load are suitable for this trailer.

4. Insurance

You must maintain legally required liability insurance for your tow vehicle and each driver throughout the rental. Before pickup, ask your insurer whether your policy covers liability while towing a rented trailer, physical damage or theft of the rented trailer, and the cargo you intend to carry; those coverages are not the same and may be limited or excluded. JH does not provide insurance for your cargo or a damage waiver under this agreement. Any insurance JH carries is for JH's own account, not a promise of coverage for you. Your responsibility under this agreement is not eliminated because your insurer denies or limits a claim, but any payment received for the same loss will be credited so it is not charged twice.

5. Booking, pickup condition, and problems

Check current availability and book at JHTrailer.com before taking a trailer, including if you are already at the lot. A trailer's presence on the lot does not mean it is available or authorize you to take it; it may be reserved, out of service, or awaiting inspection. Before moving, unlocking, coupling to, or taking a trailer, you must complete the reservation, payment, this agreement, ID verification during booking, and the pickup steps including an insurance photo and the requested trailer photos, and the booking must confirm that the trailer is ready for you. If the system does not confirm access, contact JH and do not take the trailer.

Inspect the trailer and listed accessories at pickup, including visible tires, wheels, lights, hitch, chains, breakaway cable, brakes where equipped, deck or floor, doors, ramps, jack, winch, tarp, and dump controls where applicable. Submit required pickup photos before leaving. Tell JH immediately about preexisting damage, a missing item, or an unsafe condition; do not tow or operate an unsafe trailer. Keep your pickup photos and rental confirmation.

6. Permitted use and restrictions

Use the trailer only for lawful hauling within its limits. No passengers, unauthorized removal from the lot, subletting, unapproved driver, towing while impaired, deliberate abandonment, or removal or disabling of plates, locks, or tracking equipment. Do not modify the trailer or attach signs, paint, or equipment without JH's written approval. Do not carry explosives, flammable liquids, hazardous waste, asbestos-containing material, contaminated soil, or unlawful materials. Ordinary jobsite access is allowed if the route and ground are safe for the trailer; do not drive on terrain that could cause it to sink, roll, or strike the underside. Do not continue towing, loading, unloading, or dumping when you know something is damaged or operating unsafely.

Dump trailer materials: no asphalt, concrete rubble or demolition pieces, wet concrete, or loose cement. This includes mixed loads containing any of those materials. Cement or concrete mix in sealed, intact bags is allowed if the bags are secured, remain sealed, and the load stays within the approved weight and towing limits; do not mix or pour concrete in the trailer.

Dirt, soil, sand, gravel, rock, and other unusually heavy dump-trailer loads require JH's written approval before booking, including approval by text or email. Tell JH the material, estimated quantity and weight, and tow-vehicle details. JH's approval will identify the material and a maximum cargo weight for that rental. For purchased bulk material, obtain the supplier's weight ticket or other written weight record. If the actual weight is uncertain, establish it with a scale before towing on public roads; do not rely on photos, bucket counts, bed fullness, or JH's approval as proof of weight. The permitted load is the lower of the approved cargo weight, 10,900 lb, and the weight allowed by the tow vehicle, hitch, trailer, and applicable axle and road limits.

For the dump trailer, keep bulk material at or below the 24-inch sides and within the approved weight limit; do not mound it above the walls. Distribute the load evenly and use the supplied tarp for loose material during travel. Do not dump on unsafe or prohibited ground, overload one side, or use the bed as a platform for people. If overloaded, do not tow or raise the bed to remove the excess; contact JH and have the excess removed safely with suitable equipment or by hand. You are responsible for lawful loading, securement, transport, disposal, and cleanup of the material you carry. Disposal fees are your responsibility, and the trailer must be returned empty.

7. Damage, loss, and charges

You are responsible for damage, missing equipment, or loss that occurs between pickup and the completed return time, except ordinary wear, preexisting damage, and loss caused by JH's own negligence or by events after a properly completed return. This includes damage caused by overloading, poor securement, incorrect hitching, collision, unsafe dumping, or misuse by you or an approved driver. Theft or vandalism during your possession should be reported promptly to JH and the police; JH will consider the circumstances and evidence rather than treating every event as automatic renter damage.

If you owe for damage, JH may charge the reasonable cost to repair it or, if repair is not practical, the reasonable replacement value of the damaged item or trailer, less any salvage value. Missing listed accessories may be charged at their reasonable replacement cost. Extra cleaning is chargeable only when debris, material, or soiling beyond ordinary use requires cleaning, at the actual reasonable cost. JH will use pickup and return photos, inspection records, dated invoices or a written estimate, and any other relevant evidence to explain an itemized post-rental charge. JH will credit payments from you or an insurer for the same loss and will not charge both replacement value and repair cost for the same item.

Loss of use may be charged only for actual, reasonable days the trailer cannot be rented because of damage for which you are responsible, while JH reasonably arranges and completes repair or replacement. It is calculated at the trailer's daily rate in the accepted reservation, supported by the dates of unavailability, and stops when it can reasonably return to service. JH will not charge loss of use and a late rental charge for the same day, or charge for avoidable delays. No separate diminished-value or undefined administrative charge is created by this agreement.

8. Return and completion time

Return the trailer to the location in the reservation by the agreed deadline, empty of cargo, trash, and personal property, with listed accessories returned, doors and gates shut, bed fully lowered, and trailer secured as the return instructions require. Take clear return photos showing all sides, the interior or bed, and any damage; submit them with the completed electronic return form using the link or method in your rental instructions.

The rental ends when the trailer has been physically returned and secured at the agreed location AND you have sent the required return photos and completed return submission. The electronic completion timestamp records that return time. This applies to after-hours returns too; you do not remain liable merely because JH inspects the trailer later. Photos alone, a message saying you are done, or parking the trailer without completing the submission is not a completed return. If the return system fails, contact JH promptly before the deadline for an agreed alternate photo-and-submission method; its documented sending time will be the completion time once the same physical-return steps are met.

JH may inspect after return and seek documented charges for damage or missing items that occurred before the completion time. You are not responsible for a new loss after completed return unless it resulted from your failure to perform the required physical return and securement steps. JH is not responsible for personal property left in or on the trailer.

9. Late return and recovery

If you cannot complete return by the deadline, contact JH before it passes to request an extension. An extension is effective only when confirmed by JH in writing, including text or email. If not extended, additional rental time is charged at the daily rate in the accepted reservation; a started additional 24-hour period may count as one rental day. No undisclosed higher late rate applies.

If the trailer is not returned and you do not respond to reasonable contact, JH may seek lawful recovery and charge reasonable, documented towing, storage, and third-party recovery expenses caused by the failure to return. JH will not treat an ordinary late return as theft merely because the deadline passed; any report to law enforcement will be based on the facts.

10. Incidents and repairs

Promptly tell JH about a collision, injury, theft, vandalism, mechanical problem, breakdown, tire or wheel damage, brake or light failure, or impound. Call emergency services and police when needed or legally required. Stop towing or operating if continuing could be unsafe. Do not arrange non-emergency repair, replacement parts, or towing at JH's expense without JH's approval. Reasonable immediate action to prevent injury or further damage is allowed; keep receipts and share incident details and photos with JH.

11. Payment authorization and disputes

By signing or electronically accepting this agreement, you expressly authorize JH and its payment processor to store the payment method you provide and charge amounts you properly owe under this agreement and disclosed checkout terms. This includes rental charges, agreed extensions or late rental time, documented damage, loss or missing items under Section 7, actual cleaning costs, and documented tolls, tickets, impound and recovery expenses attributable to your rental. This authorization covers permitted charges during and after the rental. Any deposit or hold must be disclosed at checkout, including its amount and release terms.

Amounts for damage, loss, or missing items for which you are responsible under Section 7 are due immediately upon your receipt of JH's itemized written demand and supporting documentation, unless applicable law requires a later payment date. JH will explain your responsibility and the amount claimed, supported by relevant photos, inspection records, and a reasonable repair estimate, invoice, or replacement valuation. Payment of an amount properly owed is not postponed while you seek insurance approval or reimbursement. JH will credit payments for the same loss to prevent duplicate recovery.

JH will provide required notices and documentation and comply with applicable law, payment-processor rules, and card-network requirements, including any required consent or waiting period. Damage, loss, or theft card charges will be processed separately from the rental charge as required by those rules. This agreement does not override those requirements. If a card charge cannot be processed, you remain responsible for amounts properly owed and JH may request another accepted payment method or pursue lawful remedies.

If an estimate is used, JH will reconcile it with the final reasonable cost and promptly refund any overcharge. You retain your rights to question or dispute responsibility, the amount claimed, or a card transaction. An itemized demand does not by itself establish disputed liability, and JH will review the evidence and correct unsupported charges. A declined card does not erase a valid payment obligation. This authorization does not permit unrelated charges or waive rights under applicable law or the card issuer's or payment processor's dispute process.

12. Tickets, tolls, and tracking

You are responsible for tolls, traffic or parking citations, and impound costs caused by your use of the trailer during the rental. JH may pass through the actual documented amount or the amount billed to JH for your rental, with no unspecified processing fee. A trailer may have a GPS or other tracking device for location, security, and recovery; do not remove, disable, or damage it. JH will use tracking only for managing and protecting the rental and as described in its privacy policy.

13. Third-party claims and company responsibility

To the extent caused by your or an approved driver's towing, loading, unloading, or use, you agree to reimburse and defend JH against reasonable third-party injury or property-damage claims and associated reasonable legal costs. This does not cover claims caused by JH's own negligence, unlawful conduct, or failure to provide a reasonably safe trailer. JH will provide a trailer in reasonably safe operating condition at pickup and respond to reported safety problems; no term in this agreement waives rights that Michigan law does not permit you to waive. Cargo suitability and securement remain your responsibility.

14. Changes, law, and complete agreement

The agreement version you accepted, the reservation showing trailer, dates, rate, locations and listed accessories, and any written change both parties approve are the complete rental agreement. A verbal discussion does not change a written rental term unless both parties confirm the change in writing, including text or email. Michigan law governs. If a clause is unenforceable, the remaining clauses still apply to the extent permitted by law. Electronic signatures and recorded acceptance may be used for this rental.

Renter Acknowledgment

By signing or accepting this agreement, I confirm that I have read it; I am at least 25 and properly licensed; the reservation identifies the trailer, rate, dates, location, and listed accessories; a trailer's presence at the lot does not authorize removal until the booking, payment, agreement, verification, and pickup steps are complete and access is confirmed; I am responsible for safe towing, loading, and returning the trailer; I will confirm the Lamar utility trailer’s cargo limit with JH before booking and understand the listed cargo limits (Freedom 7×14TA2 enclosed 4,800 lb, PJ car hauler 10,580 lb, and Midsota HV14 dump 10,900 lb), that the Lamar has no trailer brakes, and the separate 15,400-lb GVWR of the dump trailer; I understand that asphalt, concrete rubble, wet concrete, and loose cement are prohibited in the dump trailer, sealed intact bags of cement or concrete mix are allowed within loading limits, and dirt, sand, gravel, rock, and other unusually heavy dump loads require written approval before booking; I understand that the rental ends when the trailer is physically returned and secured AND required return photos and the completed return submission are sent; and I understand the payment authorization, timing, and applicable payment requirements in Section 11 and authorize only charges permitted by this agreement and disclosed checkout terms. I consent to using my electronic signature or acceptance for this rental.
